1. TERMS & CONDITIONS
1.1 This website is owned and operated by Cheeky Peak Pty Ltd (ABN 50 629 040 768).
1.2 Access to and use of this website and the products available through Cheeky Peak Brewery website are subject to below terms, conditions and notices (the “Terms of Service”). By using the website, you are agreeing to all the Terms of Service, which may be updated, suspended or terminated by Cheeky Peak Brewery without notice in the Cheeky Peak Breweries absolute and unfettered discretion. Please take care to check this page regularly to take notice of any changes we may have made to the Terms of Service.
2. PRICING & PRODUCT AVAILABILITY
2.1 Prices can and are subject to change and this can occur without notice thereof.
2.2 All retail prices include GST. Any wholesale prices will exclude GST.
2.3 All prices advertised on Cheeky Peak Brewery website exclude delivery costs.
2.4 Sale items at lower prices are only available whilst stocks last and during sale periods.
2.5 We take all reasonable care to ensure that all details and prices of products on the Cheeky Peak Brewery website are correct at the time of online publication. However, we reserve the right to correct any publishing errors on the website and cancel orders made at the incorrect price.
2.6 From time-to-time products do sell out or for some reason are discontinued. If your order contains a product/s that are out of stock Cheeky Peak Brewery will contact you and advise of the stock issue. Additionally Cheeky Peak Brewery reserve the right to either refund you for that item or put the item on backorder until the product arrives.
3. CHANGING YOUR ORDER
3.1 Once your order has been placed and the order has been received by our staff for picking and packing it is not possible to change the order. However, we are flexible and if you contact us within 8 hours of making the order then we will allow for changes.
4. PICK AND PACKING EXPECTATION
4.1 Pick & Packing times of 2-3 business days is expected when placing your online order (excluding express postage where 1-2 business days can be expected).
4.2 If packing times are to extend past expected times, Cheeky Peak Brewery will contact you to advise of the reason for delay. It’s important to attach your phone number to your order to allow for prompt contact if required.
4.3 Fresh ingredients (grain, hops, yeast, malt extract) will ONLY be packed from Monday-Wednesday to avoid being kept in postage depots over the weekend period. Any ingredient orders placed after 9am Wednesday will be packed from the following Monday.
5. LOCAL PICKUP ORDERS
5.1 Orders placed online for local pickup will need to allow for at least 24 hours for orders to be picked and packed ready for collection.
5.2 Walk in orders for fresh ingredients will NOT be able to access bulk buying discounts with grains, hops, malt and malt extract. It is advised to place your order online so you can access discounts and have your order ready for pickup on arrival.
6.1 Cheeky Peak Brewery ship all our products Australia wide. From time-to-time our website will not give you a postage option/quote, in those cases please contact us directly and we will search across the number of freight companies we use to get the best price we can for freight. If we just put in one single freight company on our website, you will have excessive shipping charges. Therefore, on bulky items we like to find you the best price we can.
6.2 Free Shipping items or items with Free Postage in the product heading and/or description are the items where freight is included with the purchase. To get your free shipping choose the “Pick Up From Store” option at checkout and we will free ship that item. If you purchase other items with free shipping items that do not have free shipping included, shipping for those extra will apply to those items only and not the free shipping items. In the case that you have selected a combination of “free shipping” items and “paid shipping items”, continue to select “pick up from store” and Cheeky Peak Brewery will be in contact to advise you of the additional shipping charges.
6.3 Please ensure accuracy when entering the delivery address for your order; especially where orders are addresses to a gift recipient. Unfortunately, we are unable to redirect parcels once they have left Cheeky Peak Brewery. Where the shipping address differs from the billing address, please ensure permission is obtained for the disclosure of personal information under the Privacy Act for third party recipients.
6.4 Please be advised that delivery time is out of our control and if we advise you of the delivery time it will only be an estimation based on estimations freight companies supply us. Due to reasons such as road traffic, air traffic, lost cartons or for any other reason it is impossible to give exact delivery times. Most orders placed will be dispatched within 2-3 business days.
6.5 All our freight or postage providers except some Australia post services allow for parcels to be left in a secure location if a signature cannot be obtained for delivery. If you are not going to home or you are not sure then please be aware that some of the freight companies we use will charge a redelivery cost so ensure at check out that you leave the necessary delivery instructions required, as Cheeky Peak Brewery will not pay redelivery costs.
6.6 For delivery to company addresses or workplaces, the Company Name and Floor/Level must be included in the address details.
6.7 Please check the delivery address carefully, as parcels cannot be redirected once in transit.
6.8 Where an order is returned to us as unclaimed, refused or insufficiently addressed, we will contact you by email for further instruction. Please note that additional delivery charges will apply to have these orders resent.
6.9 Delivery may occur in multiple parcels. For many orders that we dispatch they will be dispatched in multiple carton consignments. If some of the cartons are missing, please do not worry, it is more than likely that within a couple of business days the remaining cartons will be delivered.
6.10 From time to time it is possible that cartons are lost or stolen. It will take 10 business days for us to ensure that the lost/stolen carton is in fact lost or stolen. Once 10 days have expired with no known whereabouts of the carton a replacement can be issued at Cheeky Peak Breweries discretion. If the item has been left as per the delivery instructions and it is stolen, then Cheeky Peak Brewery reserve the right to not refund or reimburse you for the products ordered.
6.11 If your order is damaged when it arrives it is EXTREMLY important that you notify us of the damaged goods within the first 14 days. If the goods are not alerted to us as being damaged within the first 14 days Cheeky Peak Brewery reserve the right not to replace or refund the goods.
Additional Delivery Charges
On occasions, we reserve the right to adjust delivery costs especially on very large and bulky items. You will be contacted and asked to accept these charges before your order is dispatched. You may cancel your order at any time prior to dispatch.
Additional delivery charges may apply where a parcel has been returned, unclaimed, refused or insufficiently addressed.
7. SECURE PAYMENTS

7.2 We regret that we are unable to process sales using American Express cards.
7.3 As there is sometimes a delay between placing your order and payment being made/taken, we appreciate that funds may not be available at the time your order is ready to be dispatched. Your items will be held aside for you for 5 business days, if payment is not received the order will be cancelled.
7.4 By placing an order, you are offering to purchase items from us on and subject to the Terms of Service contained herein. Cheeky Peak Brewery may accept or reject this offer at its discretion at any point up until the order is dispatched. For example, but not limited to, if the payment method appears fraudulent.
We reserve the right to cancel the Customer Account.
8. RETURNS, REFUNDS & EXCHANGES
8.1 Any second-hand products that you purchase (such as second hand kegs) are not refundable and not returnable.
8.2 After 14 days have expired after the order has been received Cheeky Peak Brewery will not accept returns or issue refunds.
8.3 If for any reason goods are returned within a 14 day period, you will be charged a 15% restocking fee. Cheeky Peak Brewery reserves the right to accept or deny refunds or returns.
8.4 Delivery and packaging charges are not refundable. Additional delivery charges will apply for exchanges.
8.5 Where the original payment was made by gift card the refund will be issued to a new Cheeky Peak Brewery Gift Card and posted to you.
9. GOVERNING LAW and JURISDICITON
9.1 These Terms of Service are to be construed in accordance with the laws of Victoria, Australia and in the event of any dispute or claim associated with these Terms of Service, that dispute or claim shall be subject to the exclusive jurisdiction of Victoria, Australia.
10. CHEEKY PEAK BREWERY COPYRIGHT NOTICE
10.1 Cheeky Peak Brewery materials, including pages and online images, are protected by the Copyright Laws of Australia. All rights are reserved.
10.2 When you access the Cheeky Peak Brewery website you agree that you may retrieve the materials for information only. You may save a local copy or send it to your printer for your own personal use or in order to inform authorised and potential users about Cheeky Peak Brewery materials. However, you may not make any charge for such use and any commercial exploitation is expressly prohibited.
11. NOTICE OF TRADEMARK
11.1 The Cheeky Peak Brewery logo is a registered trademark of Cheeky Peak Pty Ltd. The Cheeky Peak Brewery logo may not be used without the prior specific, written permission off Cheeky Peak Pty Ltd.
